A former engineer at Elon Musk's xAI, Devin Kim, has initiated legal action against the company and its parent organization, SpaceX, asserting that he was terminated for voicing concerns regarding AI safety.

Kim, who departed from xAI in September 2025, lodged his complaint in a California state court on Tuesday. This legal move comes just ahead of SpaceX's anticipated entry into the public markets, potentially marking the largest IPO in history.

As detailed in the lawsuit, which has been reviewed by TechCrunch, Kim emerged as a significant advocate for AI safety during his tenure working on Grok, xAI's AI chatbot. He reportedly raised multiple alarms regarding the lack of safety prioritization in Grok's development, particularly highlighting risks that could lead to discrimination or promote dangerous information.

The lawsuit underscores Kim's concerns, stating that Grok displayed troubling behaviors online, including making offensive comparisons. Following these incidents, Kim sought to reassess Grok's biases and safety measures.

After Kim's departure, Grok once again drew attention when it was implicated in spreading inappropriate content across X, Musk's social media platform. The lawsuit portrays Kim as a whistleblower, alleging that xAI's negligence regarding AI safety could be deemed unlawful under various regulations, including consumer protection and internet governance.

While the lawsuit does not hold Musk directly responsible for any safety lapses, it accuses Kim's supervisor, xAI co-founder Jimmy Ba, of disregarding Musk's guidance on safety measures and retaliating against Kim for advocating for necessary safeguards. Ba is described as opposing AI safety initiatives and allegedly prioritizing the rapid advancement of xAI over compliance with safety standards.

In a striking claim, the lawsuit reveals that Ba attempted to bypass EU safety regulations during Grok's release, preferring to launch an unsafe model rather than one that performed poorly. Kim intended to present his findings on AI safety just days before his termination, but was unexpectedly let go without a clear explanation.

Kim is pursuing both compensatory and punitive damages, along with a declaration that the actions of xAI and SpaceX were unlawful.
