The healthcare provider, which caters to over 12.5 million members, has recently reached a $10.5 million settlement regarding a class action lawsuit concerning marketing texts sent after individuals requested to opt out. The lawsuit, initiated in August 2025, alleged that Kaiser Permanente did not respect the opt-out requests of recipients. Those eligible could receive as much as $75 for each qualifying text message.
Are You Eligible for the Kaiser Settlement?
To qualify for compensation from this settlement, you must have received multiple text messages from Kaiser Foundation Health Plan Inc. within a 12-month timeframe--from January 21, 2021, to August 20, 2025--after you sent a "stop" or similar opt-out request. Please note that simply confirming your request does not count as an opt-out.
The settlement covers two distinct classes: one for recipients in Florida and another for those across the United States.
How to Claim Your Settlement Cash
To receive your compensation, you must submit a valid claim form by February 12, 2026. If you received a notice of eligibility via mail or email containing a unique ID and PIN, you can complete your claim online. If you did not receive such a notice, you will need to download and submit a paper claim form to the settlement administrator. Ensure that any hard copy claims are postmarked by February 12.
While the maximum payout per text is $75, the total amount you receive may vary based on the number of claims submitted. Please be aware that it may take several months for payments to be distributed as the settlement details are finalized, so immediate funds should not be expected.
