Court Allows NAACP Lawsuit Over xAI Data Center Permits to Proceed

A federal judge has declined to dismiss the NAACP's lawsuit over air permits for gas turbines at xAI's Colossus data center near Memphis. The ruling allows the case to proceed; it does not resolve whether the company violated environmental requirements.

The NAACP, represented by the Southern Environmental Law Center, alleges that xAI installed and operated at least 35 combustion turbines at the site without obtaining required permits. The lawsuit claims this breached the Clean Air Act.

xAI argued that the turbines are mobile sources exempt from permitting rules and challenged the plaintiffs' right to bring the case. Judge Debra M. Brown rejected those arguments, finding that the turbines were not classified as mobile sources under Mississippi's State Implementation Plan and that the plaintiffs had standing under the Clean Air Act.

The judge also concluded that the law's citizen-suit provision does not improperly transfer executive authority to private parties. The case will now continue, giving the court an opportunity to consider the underlying claims. Its outcome may help shape how permitting rules apply to the energy systems supporting large-scale AI computing.
