The case involves Atlanta resident Samuel Tunick, whose legal team says the phone was searched after he returned to the United States through Atlanta's Hartsfield-Jackson airport in January 2025. His attorneys argue that the device was improperly detained and that the evidence should not be used in court.

At the center of the dispute is GrapheneOS, a privacy-focused Android system that includes a duress passcode feature. When entered, that code can erase the device's contents instead of unlocking it. Tunick's lawyers confirmed the software was installed on his phone.

The indictment says he knowingly used a passcode that caused the phone to delete its digital contents before the device was seized. Prosecutors are relying on a federal law that bars the intentional destruction of property to prevent government seizure. Tunick has pleaded not guilty.

Digital security specialists say the case is unusual and could influence how travelers think about device privacy at international borders. The Electronic Frontier Foundation has long advised users to review their data protection options before crossing borders, especially when carrying sensitive information.

As courts examine the legal boundaries of device searches and privacy tools, the outcome may shape future conversations about digital rights, border technology, and secure-by-design mobile systems.
