Users who have interacted with Google Assistant may find themselves eligible for a share of a recent $68 million settlement. However, many might miss the notification as it is reportedly landing in spam folders.
According to reports, the settlement notices are being misclassified as spam, which could lead to eligible individuals overlooking their chance to claim compensation. I personally discovered the notice in my spam folder, labeled "Google Assistant Privacy Litigation Settlement." Although it resembles typical spam, it is indeed a valid notice.
Understanding the Google Settlement
This settlement arises from allegations that Google Assistant recorded conversations without explicit user activation, such as the wake phrase "Okay Google." This could affect a wide range of users, given that Google Assistant is available on various devices, including Google's own products and third-party devices.
The notifications sent via email inform eligible users about the claim submission deadline and include a unique ID and PIN for the claiming process. Importantly, users can still file claims even without these codes, as stated on the settlement website.
Eligibility for Settlement Payouts
Two distinct classes of individuals are eligible for compensation:
Purchaser: Individuals who acquired a "Google-Made Device" utilizing Google Assistant in the U.S. from May 18, 2016, to March 19, 2026.
Privacy: Users of Google Assistant (or members of their households) who had their communications recorded without consent during the same timeframe.
At this point, the exact payout amount for each claimant remains unclear. The distribution will be based on a points system, where "Purchaser" class members can claim for up to three devices, earning four points for each, while those in the "Privacy" class receive one point.
Claim Submission Process
Eligible claimants can submit their claims online through the settlement website. They should log in using their unique ID and PIN if available, or complete a verification form. Claims must be submitted by August 27, 2026, with the final approval hearing set for October 1, 2026, after which payments are expected to be distributed.
