An appeals court has ruled that the EPA lacked the authority to cancel and reclaim climate funding that had already been transferred to nonprofit organizations. The decision keeps billions of dollars available for clean energy initiatives tied to the Inflation Reduction Act.
The case centers on the Greenhouse Gas Reduction Fund, a $20 billion program designed to support projects that help communities and businesses move toward lower-emission energy systems. Several nonprofit recipients had their accounts frozen in February 2025 after federal agencies moved to halt the flow of funds.
In its ruling, the U.S. Circuit Court of Appeals for the District of Columbia Circuit said the money could not be taken back simply because of a policy shift. The judges also noted that the funds had already been obligated and deposited, which limited the government's ability to reverse the transfer.
The decision gives the organizations renewed access to the money while the EPA considers whether to seek review from the Supreme Court. Some groups, however, have already reduced staff and operations during the freeze period.
