The Ansel Adams Publishing Rights Trust has expressed strong disapproval of New York City gallerist Peter Danziger's recent sale of AI-colorized versions of one of Adams's most iconic photographs at an art fair last month. In a public statement, the Trust criticized Danziger for failing to inform them about his use of the image, asserting that it misappropriated Adams's name, reputation, and artistic legacy.
In defense, Danziger stated that he was within his rights to create a new interpretation of Adams's renowned black-and-white photograph, "Moonrise, Hernandez, New Mexico" (1941), as it is in the public domain. He showcased an AI-generated image at The Photography Show presented by the Association of International Photography Art Dealers (AIPAD), utilizing a prompt to create a realistic color rendition of the original work. This piece was displayed alongside contemporary works from various artists.
At the fair, Danziger offered ten editions of the AI-generated image in three different sizes. However, he did not disclose the sales figures or pricing. The Trust reiterated that they were not consulted prior to the image's exhibition and reached out to Danziger once they became aware of the situation, requesting the work's removal.
In their statement, the Trust emphasized their respect for creative exploration and innovation, acknowledging Adams's own interest in the influence of technology on photography. Their concern lies primarily in the commercial use of Adams's legacy without permission. They stated, "No one should trade on another person's name, reputation, and labor for private commercial ends without consent and candor."
Danziger has since apologized for not informing the Trust beforehand, asserting that his intention was to honor the original work and the artist. He described the generative AI image as a respectful homage to the scene that inspired Adams to capture the moment.
The AIPAD has acknowledged the seriousness of the matter, with its Board of Directors actively addressing the situation. They maintain high ethical standards for their members and have formed an ethics committee to update their bylaws, particularly concerning artificial intelligence.
